Burton Online Rental Terms of Use
Burton Japan G.K. ("Company") provides Burton Online Rental Service ("Rental Service") to the customer ("User") subject to the following terms of use ("Terms of Use"). By using this Rental Service, User agrees to all Terms of Use. Any matters not specified in this Terms of Use and/or rental agreement shall be governed by the provisions of the Civil Code of Japan.
Scope and Amendments
This Terms of Use apply to both Company and User. Company reserves the right to modify this Terms of Use at any time without User’s prior consent. The updated this Terms of Use take effect upon notification to User or posting on Company’s website. User’s continued use of this Rental Service following any changes constitutes User’s acceptance of the revised terms.
Rental Equipment
Rental items include a snowboard, boots, bindings (3-piece set), or boots and bindings (2-piece set), and wear (top and bottom set),helmet, snowboard. All accessories, if applicable, are considered part of the rental item.
Eligibility
User must provide valid identification and be able to make payments via credit card.
Rental restrictions or cancellations may apply if:
The application contains false information.
Previous rental equipment have not been returned, or there was a history of late returns.
Any prior payment for this Rental Service was delayed or unpaid.
Use of Personal Information
Company values the personal information provided by User and handles it in accordance with Company’s Privacy Policy and applicable privacy laws, including the Personal Information Protection Law, as outlined in separately posted "Company’s Privacy Policy". Please refer to Company’s Privacy Policy for details. By agreeing to this Terms of Use, User agrees to allow Company to provide User’s personal information to third parties to the extent necessary to achieve the purposes of use of personal information as stated in Company’s Privacy Policy, or in the following situations.
Company’s parent company and group companies located overseas ("Overseas Companies")
Third party contractors located overseas to whom Overseas Companies outsource their operations.
Overseas payment processors, mainly located in the Netherlands and the United States (including credit card fraud detection services)
Third party contractors for this Rental Service operation
Payment Methods
Payments for this Rental Service can only be made by credit card on our website.
Shipping
Rental equipment will be shipped to addresses designated by the User within Japan.
Company will deliver rental equipment to User on the agreed start date, and User must return rental equipment by end date through the designated carrier or location by Company.
If Company determines that Company cannot deliver rental equipment at the location designated by User, Company may request User to change the delivery location or cancel the rental agreement.
Shipping is only available to destinations within Japan, expect Okinawa and remote islands.
Company shall not liable for any delays due to reasons related to carrier, weather, or traffic conditions, including any damages incurred by User as a result of such delays.
Rental equipment is deemed acceptable if no issues are reported within 24 hours of receipt by User. Any complaints beyond this period will not be accepted.
Return Methods
User shall place the rental product into the provided snowboard bag and return it via the method specified by Company to the designated location.
If the rental equipment is returned using a method other than that designated by Company, User will be billed for the associated costs.
Order Cancellation
Cancellations made more than 4 days before the rental start date are free of charge.
Cancellations made 3 days before the rental start date up to the day before the rental starts will incur a 50% cancellation fee of the rental cost.
Cancellations made after this period will incur a 100% cancellation fee of the rental cost.
Malfunction and Damage
If a malfunction or damage occurs with the rental equipment, User must immediately cease use and contact Company without delay.
In cases of damage or soiling, Company will inspect the condition of the returned product and provide further instructions. If User agrees to the terms provided, Company will issue a revised invoice, and payment must be made according to the specified method.
Theft and Loss
In the event of theft or loss, User must promptly notify the inquiry desk.
If the rental product is stolen or lost due to User's negligence, Company will charge user for the amount of the damages incurred.
In the case of theft, User must file a report with the police and notify customer service with the report number.
Rental Period
The rental period is defined as the time from User's designated "start date" of the rental product until the "return date." The return date will be considered the date on which User hands the rental equipment to the delivery service.
The return deadline for the rental product will be communicated to User separately by Company.
Early returns before the end of the rental period do not entitle User to a reduction in the rental fee confirmed at the time of order.
Extensions of the rental period are not permitted.
Overdue Returns and Late Fees
If the rental product is not returned to Company by the specified return deadline, a late fee will be incurred.
The late fee will begin accruing the day after the return deadline at a flat rate of 3,000 yen per day.
Payment of the late fee will continue until the rental product is confirmed returned by Company.
If the overdue return causes damages to a third party, Company reserves the right to seek compensation for those damages.
Accidents
In the event of an accident during the rental period, User must promptly contact customer service.
User should notify the police or other relevant authorities as necessary and take appropriate actions themselves.
If damages are caused to Company or a third party due to User's negligence, User shall be responsible for compensating those damages.
Company shall bear no responsibility in cases requiring settlements related to the accident.
Prohibited Activities
1. User is prohibited from using the rental products for the following purposes or in the following ways:
1. Transfer or resale.
2. Modification or alteration of the rental equipment, or the creation of counterfeit products.
3. Provision to a third party or use by a third party.
2. Company reserves the right to demand the immediate return of the rental product from User or the third party if any prohibited activities are confirmed. User shall be solely responsible for any damages incurred as a result of such a return demand.
Invalidity and Termination
If any of the following conditions occur, Company reserves the right to invalid, cancel or terminate User’s application without any notice and to request the return of the rental equipment immediately
1. There is false information in the application.
2. User violates this Terms and Use.
3. Payment processing fails to complete successfully.
4. Any other reason deemed inappropriate by Company.
Company shall bear no responsibility for any damages arising from the invalidity or termination of the rental agreement.
Jurisdiction
Any and all disputes arising out of or in connection with this Terms and Use shall submit to the exclusive jurisdiction of the Tokyo District Court at the first instance.
